This writ petition is under Article 226 of the Constitution of India for seeking direction upon the respondents to grant upgradation in pay scale under ACP/MACP Scheme with effect from the due date.
Learned counsel appearing for the respondent-State has placed the order passed by the competent authority granting benefit of upgradation under ACP Scheme and MACP Scheme, vide order 2 dated 18.11.2023.
Mrs. Ritu Kumar, learned counsel appearing for the writ petitioners has submitted that the decision has been taken by granting upgradation in pay scale, but she, on instruction submits that the financial benefit, in lieu of upgradation in pay scale, has not been released.
This Court, considering the aforesaid fact and taking into consideration the fact that the competent authority has already come out with the decision granting upgradation in pay scale, therefore, is of the view that the writ petition is to be disposed of.
Operative part
Accordingly, this writ petition stands disposed of.
However, the financial benefit which has not yet been given, in pursuant to the order dated 18.11.2023, the same is to be given within the period of two months’ from the date of receipt of copy of this order. Rohit/- (Sujit Narayan Prasad, J.)
