The present criminal writ petition has been filed for following reliefs:- i. For direction upon the respondents, especially respondent No.3 and 4 for compliance of the order dated 16.12.2022 passed in Cr.M.P. No.4165 of 2022 by which Hon’ble High Court has been pleased to hold that there is no illegality in order dated 09.09.2021 (passed in Complaint Case No.4499/2017) by which process u/s 82 of Cr.P.C. and accused/ respondent no.5 were directed to appear before the court on or before 22.12.2022 with further direction that if Accused persons/ Opposite Party No.5 failed to appear before the learned court below on or before 22.12.2022, all coercive measures shall be taken against the Accused/Respondent No.5. ii. For direction to the respondent No.3 and 4 to take necessary steps for appearance of the accused/ respondent No.5 before the court of law as he is evading the order of the Hon’ble Court since last four year in spite of process issued against him under chapter-V of Code of Criminal Procedure. iii. For direction respondent No.3 and 4 to arrest accused/respondent No.5 immediately, as he is a habitual offender and having several criminal antecedents apart from this instant case.”
Learned counsel for the petitioner has submitted that he wants to withdraw the present writ petition with a liberty to approach the court below for further remedy.
