18.4.2016 passed by the learned Deputy Commissioner cum Adjudicating Officer, Bokaro in Food Safety and Standard Case No.7 of 2014. There is provision of appeal under section 70 of the Food Safety and Standards Act, 2006. The learned counsel for the respondent State submits that by notification dated 13.7.2020 the appellate authority has already been notified in view of the said Act and the Principal District and Sessions Judge of the concerned district as well as Judicial Commissioner for Ranchi district have been notified as appellate authority in view of the said notification. Mr. Mukesh Kumar, the learned counsel for the petitioner seeks permission to withdraw the instant petition with liberty to file the appeal. With aforesaid liberty, this petition is permitted to be withdrawn and stands disposed of with the said liberty. If any issue of limitation arises in filing the appeal, the pendency of the petition shall be considered by the learned appellate court. Disposed of. SI/, ( Sanjay Kumar Dwivedi, J.)
