Oral Order 02/ Dated :15.06.2022 The anticipatory bail application filed on behalf of petitioner- Ajeet Yadav @ Ajeet Kumar, who is apprehending his arrest in connection with Complaint Case No.669 of 2019 for the offence registered under Sections 323, 406 & 420 of the I.P.C. pending in the Court of Md. Danish Nawaz, learned Judicial Magistrate, 1st Class, Koderma, is pressed into motion. The case of the complainant is that he had sold his truck for a consideration amount of Rs.1,70,000/- in which this petitioner acted as a guarantor and assured that balance amount of Rs.1,00,000/- will be paid in installment. It is submitted by the learned counsel that the petitioner was only guarantor and the amount had to be paid by main accused Chandan Kumar Singh however, he is ready to pay the balance amount of Rs.1,00,000/- to the complainant. Learned A.P.P. has opposed the prayer for bail and submits that petitioner was guarantor and it was agreed that the loan amount will be paid in installment. Under the aforesaid facts and circumstance, the anticipatory bail application is allowed. Accordingly, the petitioner- Ajeet Yadav @ Ajeet Kumar, is directed to surrender before the learned Trial Court within a period of four weeks and in the event of his arrest or surrender, he shall be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand only) with two sureties of the like amount each to the satisfaction of the Court below, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure and further with the condition that the petitioner will deposit a bank draft in the name of complainant for a sum of Rs.1,00,000/-. This amount will be adjusted in the final settlement and composition of offence. The petitioner will co-operate in the investigation and will appear under Section 41A Cr.P.C. as and when required and comply with the condition as laid down under Section 438(2) of the Cr.P.C.
