This Criminal Revision No. 191 of 2022 has been filed under section 101 (2) of the Juvenile Justice (Care & Protection, of Children) Act challenging the judgment dated 14.02.2022 passed by learned Additional Sessions Judge-1st cum Special Judge Children’s Court, Deoghar in Criminal (Juvenile Bail) Appeal No. 04 of 2022 affirming the order dated17.01.2022 passed by the learned Principal Magistrate, Juvenile Justice Board, Deoghar, in connection with Jasidih P.S. Case No. 359 of 2021 corresponding to Inquiry No. 170 of 2022. For offence under section 399 & 402 of the I.P.C. and section25 (1-B) a of Arms Act.

Heard, learned counsel for the petitioner and learned counsel for the State.

It is submitted that the petitioner has been arrested with one cartridge whereas the other co-accused person namely Umesh Prasad Yadav was arrested with one desi loaded pistol and Vishal Kumar Das was arrested with one bullet of 765 M.M pistol. It is submitted that the Co-accused namely Umesh Prasad Yadav , Pritam Kumar Deo @ Bittu @ Pretam Kumar Dev and Man Kumar Mishra @ Maan have been granted bail by the Co-ordinate Bench of this Court and also by this Court vide B.A. No. 548 of -2 2022 vide order dated 04.02.2022 , B.A. No. 16304 of 2021 vide order dated 09.02.2022 and B.A. No. 723 of 2021 vide order dated

23.02.2022 annexures 4,5,and 6 this Criminal Revision application. The petitioner is custody since 22.10.2021, hence he may be enlarged on bail.

On the other hand, the learned A.P.P. appearing for the State has opposed the prayer for bail application and submitted that one cartridge was recovered from the possession of this petitioner.

Perused of the record of this case and Order passed by the Co-ordinate Bench of this Court and by this Court.

It transpires that secret information the police arrested four persons including this petitioner and two accused have been found. This petitioner has been arrested with one cartridge. It transpires that most of the witnesses are police officers. It transpire that one of the co-accused namely Umesh Prasad Yadav , Pritam Kumar Deo @ Bittu @ Pretam Kumar Dev and Man Kumar Mishra @ Maan have been granted bail by the Co-ordinate Bench of this Court and also by this Court.

Considering the facts and circumstances of this case, the petitioner Rudra Shrivastav is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand only ) with two sureties of the like amount each to the satisfaction of learned Principal Magistrate , Juvenile Justice Board, Deoghar in connection with Jasidih P.S. Case No. 359 of 2021 corresponding to Inquiry No. 170 of 2022 , subject to the condition that one of the bailers must be own relative i.e. father of the petitioner. Accordingly, this Criminal Revisions stands disposed of. Bibha/ (Sanjay Prasad, J.)
