----- CORAM: HON’BLE MR. JUSTICE SANJAY KUMAR DWIVEDI ----- For the Petitioner For the State : Mr. Ranjan Kumar, Advocate : Mr. Rakesh Ranjan, A.P.P. ----- 04/28.01.2026 Heard learned counsel appearing for the petitioner and learned counsel appearing for the State.

The petitioner is apprehending his arrest in connection with Jorapokhar P.S. Case No.95 of 2024, registered for the offence under Section 379 of the Indian Penal Code, pending in the Court of the learned Judicial Magistrate, 1st Class, Dhanbad.

Learned counsel appearing for the petitioner submits that the motorcycle has not been recovered from the possession of the petitioner. He further submits that the name of the petitioner has come on the confessional statement. He then submits that the petitioner is having one criminal antecedent of similar nature. On these grounds, he submits that anticipatory bail may kindly be granted to the petitioner.

Learned counsel appearing for the State opposed the prayer and submits that the petitioner is also an accused in Tisra P.S. Case No.51/2024 and the motorcycle of the present case has been recovered in that case.

Considering that the motorcycle which is the subject-matter of the present case, has been recovered in Tisra P.S. Case No.51/2024, in which, the petitioner is also an accused and the petitioner is having criminal -1- A.B.A. No. 413 of 2026 ( 2026:JHHC:2051 ) antecedent and in the attending facts and circumstances of the case, I am not inclined to extend the privilege of anticipatory bail to the petitioner and, as such, his prayer for anticipatory bail is, hereby, rejected.
