Mr. Chaman Negi, counsel for the petitioner. Mr. R.P.Singh, Assistant Advocate General, respondent. Mr. R.P.Singh, learned Assistant Advocate General on instructions received from H.C. Parmod, No. 38, Police Station, Boileauganj, Shimla has stated that custodial interrogation of the petitioner is not required in FIR No. 238 of 2009 dated 21.12.2009 registered at Police Station, Boileauganj, District Shimla, under Section 3 of the Prevention of Damage to Public Property Act, 1984. He has further stated that in these circumstances, the petitioner may be directed to join the investigation in FIR No. 238 of 2009. In view of the statement made by Mr. R.P.Singh, learned Assistant Advocate General, the application is allowed. In the event of arrest of the petitioner in FIR No. 238 of 2009 dated 21.12.2009 registered at Police Station, Boileauganj, District Shimla, under Section 3 of the Prevention of Damage to Public Property Act, 1984, the petitioner be released on bail on his furnishing personal bond in the sum of Rs.10,000/- with one surety of the like amount to the satisfaction of the Arresting Officer with the condition that the petitioner shall continue to join the investigation as and when directed by the Investigating Officer and shall not hamper the investigation and tamper with the prosecution evidence in any manner.
