Present: Mr. Ashwani Sharma, Advocate, for the appellant. Ms. Bindiya Sharma, Advocate, for respondent No.1. FAO No. 379/2004 Learned counsel for the claimant/respondent seeks liberty to withdraw the original claim petition filed before the M.A.C.T., Chamba under Section 163-A of the Motor Vehicles Act, 1988, with liberty to file a comprehensive petition under the relevant provisions of law before the appropriate forum. Permission granted. It shall, however, be open to the appellant herein to take all such objections as may be available to it in accordance with law. In view of the withdrawal of the claim petition, the impugned Award dated 3.8.2004 passed by the Motor Accident Claim Tribunal, Chamba, in M.A.C. No. 97 of 2001 is set-aside and the amount deposited by the Insurance Company is directed to be refunded to the appellant along with uptodate interest.
