Ms. Jyotsna Rewal Dua, counsel for the respondent. Cr.MMO No.28 of 2009 Heard. Learned counsel for the petitioner submits that he intends to file an appeal against the order passed by the learned Judicial Magistrate since an appeal lies under Section 29 of the Domestic Violence Act, 2005. Therefore, he is permitted to withdraw the petition and file an appeal. The time during which the petitioners had been prosecuting he present petition before this Court shall be deducted while computing the period of limitation by the learned Sessions Judge. The petition is accordingly disposed of. Records be sent back forthwith. A copy of this order be sent to the learned trial Court. Copy of this order be given Dasti. (SDS) October 22, 2009. ( V.K.
