Crl.MP.No.18861 of 2019and Crl.RC.SR.No.63133 of 2019P.RAJAMANICKAM, J.This petition has been filed to condone the delay of 467 days in filing the Criminal Revision Petition.
Though private notice was served on the second respondent and her name was also printed in the cause-list, she has not appeared in person or through counsel. Hence after hearing the arguments of the learned counsel for the petitioner and the learned Government Advocate (Crl. Side) who is appearing for the first respondent and perusing the materials placed before this Court, the order is being passed in this petition.
The learned counsel for the petitioner has submitted that the petitioner has purchased a mini lorry bearing Registration No.TN-30-AP-5396 from the second respondent but inadvertently he failed to transfer RC into his name. He further submitted that the first respondent has registered an FIR in Crime No.271 of 2014 on 12.06.2014 stating that the petitioner's aforesaid lorry was involved in transporting sand and also seized the said lorry and produced before the Judicial Magistrate No.1, Mettur. He further submitted that the petitioner has filed a petition before the concerned Magistrate seeking interim custody. The learned Magistrate has dismissed the said petition and as against the same, the petitioner has filed the present Criminal Revision Petition. He further submitted that the petitioner is a poor agriculturist and he is not able to mobilize the http://www.judis.nic.in P.RAJAMANICKAM, J.drlfunds for engaging lawyer for filing Criminal Revision and hence there is a delay of 467 days in filing Criminal Revision and therefore he prayed to condone the delay.
The learned Government Advocate (Crl. Side) who is appearing for the first respondent has submitted that he is leaving it to the decision of this Court.
Considering the fact that there is an inordinate delay of 467 days, this Court is inclined to allow this petition by imposing cost.
In the result, this Criminal Revision Petition is allowed on deposit of Rs.500 to the credit of Chief Justice Relief Fund on or before 18.03.2020 failing which this petition stands dismissed without further reference to this Court.
