P.C. : The applicants seek bail in Crime No.226 of 2011 of Sangola Police Station, District Solapur. The offence is registered against the applicants under Section 302 r/w. 34 of IPC. On 13.8.2011 at about 2.00 p.m., witnesses saw the applicants beating victim Popat with hard and blunt objects like wire and chappal. They accused him of making a complaint against them etc. and then they were also seen taking the victim with them to their house in their vehicle. Thereafter, the victim came back to his house in injured condition. There was one bleeding injury on his head. After sometime, the victim collapsed and while on way to hospital, he died. 2 2 BA-253-2012 The medical opinion or the postmortem notes show that the victim died because of bleeding in pericardium and pressure on heart due to such bleeding. The report also shows that the victim had suffered a broken rib. This indicates that the victim was given blows on his torso, due to which he sustained trauma and ultimately died. 3 The question is whether the applicants knew that their beating would cause death of the victim. The answer is apparently, they were not knowing the consequence of their acts. The applicants therefore have a good defence in the case, in which they are accused of committing murder. They would be able to show that they had no intention or knowledge, that their acts would cause death of the victim. 4 In view of this, the applicants make out a case for bail. The applicants are in custody since September 2011. The charge sheet is already filed. The applicants are released on bail of Rs.25,000/­ each with one or two surety / sureties each in the like amount. (A.V.NIRGUDE, J.)
