Heard Shri Lokhande, learned counsel for the petitioners, Shri Kulkarni, learned counsel for respondents No.1 to 3 and Shri Kidilay, learned counsel for respondent No. 4. Admittedly, the Change Report submitted by the petitioners has been rejected by the Assistant Charity Commissioner. Shri Lokhande, learned counsel states that the appeal against that rejection is still pending. Shri Kulkarni and Shri Kidilay, learned counsel for the respective respondents state that the University has asked the correspondence with it to be only through the Secretary recorded in Schedule I. We find that the petitioner can obtain appropriate orders in this respect in appeal which has been filed under Section 70 of the Bombay Public Trusts Act, 1950. With that liberty to the petitioner, 212wp2823.11 we dispose of the present writ petition. However, there shall be no order as to costs. JUDGE JUDGE *GS.
