By consent, the Application is being disposed of on following terms:- (I) The impugned order recording issuance of notice to the applicant stands quashed. (II) The Application filed by the respondent to be considered afresh and the learned Magistrate may call for the report under section 12 of the Protection of Women from Domestic Violence Act, 2005 and may proceed further in accordance with the law. The evidence which has been recorded so far, may not be considered and de-novo enquiry to be held. 2 Cr.Appln. 4097.09 (III) The learned Magistrate to expeditiously dispose of the Application of the respondent as far as possible within a period of nine (9) months.
