In the absence of such an order in writing having been passed, this petition cannot be :2: entertained and the petitioner may be at liberty to initiate fresh appropriate legal proceedings on receipt of either a failure report or an order refusing to make a reference to be passed by the competent authority in the Ministry of Labour, Government of India. .
