Judgment

Both the counsel state that the matter is identical to Company Petition No.44 of 2010 which was disposed of by a judgment and order dated 12.3.2010.

The Company Petition is also taken out by a Director of Petitioner Company under Sections 560(6) and 560(7) of the Companies Act, 1956 for setting aside of the order of the Respondent, striking off the name of the petitioner Company and seeking restoration of the registration of the Petitioner Company.

The learned advocate appearing for the Respondent states that he has no objection if the petition is allowed in terms of prayer clause (a). He submits however that the Court may direct the Petitioner Company to make good the offences arising out of non-compliance of Sections 266-A to 266-G, 159 to 162, 166 and 220 etc. of the Companies Act, 1956. 2

The Company Petition is allowed in terms of prayer clause (a). However, the Petitioner Company shall file all statutory returns and compliances electronically under the various provisions of Companies Act, 1956 with the Registrar of Companies within a period of eight weeks from today. The Petitioner Company has stated that the Company shall make appropriate application under Section 621-A of the Companies Act, 1956, for compounding the aforesaid violations/offences. The statement is accepted.

Parties to act upon an ordinary copy of this order duly authenticated by the Associate of this Court.

The Company Petition is accordingly disposed of.
