On behalf of respondents learned Counsel draws our attention to the Judgment of this Court dated 22nd December, 2006 in Writ Petition No.5526 of 1995 and companion petitions where the validity of deleting Section 37 from the Maharashtra Medical Practitioners (Amending) Act, 2005 has been upheld. The petitioners have come to this Court to strike down the same. Once the issue has been concluded by the Division Bench of this Court the Rule has to be discharged as nothing survives in this petition which is consequently dismissed.
