Petitioner claims to be the owner of the land and according to her Respondent no.4 is in illegal occupation. There is no material before this Court to show that the petitioner is the owner of the property. Considering that the petition raises disputed questions of fact, this is not a fit case for this Court to exercise its extra ordinary jurisdiction. . It will be open to the petitioner if so advised to file proceedings before Civil Court or any other competent authority for declaration of their right to the property and if they succeed then to seek reliefs as per law. .
