Heard the learned counsel for the petitioner. The complaint (ULP) No. 238 of 2003 has been filed before the Industrial Court at Kolhapur by the Municipal Transport Rashtriya Karmachari Sangh a registered trade Union and the Kolhapur Municipal Transport as well as the Kolhapur Municipal Corporation have been impleaded as the respondents. An application for interim relief below Exh. U-2 filed in the said complaint has been allowed by the impugned order dated 3.12.2004 passed by the learned Member of the Industrial Court.
Admittedly, the petitioner is neither the complainant nor the respondent. Two more respondents (-2-) have been added in the said complaint but the petitioner was never impleaded as respondents in the said complaint. If the petitioner is an aggrieved person by the said order, the petitioner has the remedy of filing Review Application after it is being impleaded as the respondent in the said complaint.
This petition is therefore, disposed of with liberty to the petitioner to approach the Industrial Court at Kolhapur in the pending complaint. *****
