CORAM: B ILAL NAZKI DATE: FEBRUARY 27, 2009 P.C.:- The complaint of the petitioner was that the Caste Certificate obtained by respondent No. 5 was a forged document. He made a complaint to the Municipal Commissioner, who forwarded the matter to the police. The grievance of the petitioner is that the police is not investigating the matter and is toying it from one place to another.

Counter-affidavit has been filed, in which it is stated that the matter was sent to the Caste Scrutiny Committee, and the Committee has mentioned that the Caste Certificate of respondent No. 5 was not forged. 2

In view of the fact that the Caste Scrutiny Committee also found that the Caste Certificate was not forged, we do not think that any case has been made out against respondent No. 5. Therefore, no fault can be attributed to the police for not having registered a case. The petition is misconceived, and is filed to only harass respondent No. 5. What he has not achieved in the Caste Scrutiny Committee he wants to achieve through police. The petition is dismissed. BILAL NAZKI, J. A.R. JOSHI, J.
