The petitioners state that the land admeasuring Acs.15.05 guntas in Survey No.32 of Syed Aliguda, Asifnagar, Hyderabad was notified in favour of a Wakf called as Maqbera Walajah in the Gazette, dated 30.08.1984. The petitioners contend that they being Mislims have interest in the Wakf property, and that respondent No.1 who is endowed with the duty to protect the Wakf properties is not taking necessary steps to remove and prevent encroachments. learned counsel for the respondents. The Wakf Act, 1995 (for short ‘the Act’) provides for issuance of notifications in respect of the properties that are endowed in favour of Wakfs. It is also placed under obligation to protect such properties. The petitioners claim to have made several representations alleging that the property endowed in favour the Wakf is being encroached. Respondent No.1 has to take steps in this regard. Hence, the writ petition is disposed of, directing respondent No.1 to ensure that the property, which is registered in favour of the Wakf, namely Maqbera Walajah, Hyderabad, is not encroached. However, the procedure prescribed under the Act shall be followed whenever any encroachments are removed.
