Judgment

The order under challenge, in this Writ Petition, is the order passed by the Revenue Divisional Officer, Chevella Division, Ranga Reddy District

(first respondent) dated 22.05.2010, whereby the appeal preferred by the third respondent herein was allowed holding that she was in possession of the schedule land by virtue of a registered sale deed. The first respondent further held that entries made in the cultivator’s column be treated as wrong entries. The second respondent herein was directed to incorporate the name of the third respondent, in the possessor’s column, against the land in Sy.No.500/E admeasuring Ac.3.32 guntas situated at Kanakamamidi Village, Moinabad Mandal. Aggrieved thereby, the present Writ Petition is filed by the third respondent. It is necessary to note that the order of the first respondent dated 22.05.2010 is in an appeal filed under Andhra Pradesh Rights in Land and Pattadar Pass Books Act, 1971 (for short ‘the Act’). Section 9 of the Act confers power on the Collector, either suo motu or on an application made to him, to revise any order passed by a subordinate officer. Since the questions raised in this Writ Petition can as well be raised before the Collector in proceedings under Section 9 of the Act, I see no reason to exercise discretion, under Article 226 of the Constitution of India, to entertain this Writ Petition. Leaving it open to the petitioner, if he is so aggrieved, to approach the Collector under Section 9 of the Act, the Writ Petition is dismissed. However, in the circumstances, without costs.
