At the hearing, it is brought to the notice of this Court by the learned counsel for the respondent-complainant and fairly conceded by the learned counsel for the petitioner that the petitioner herein had earlier filed a similar Criminal Petition, which was numbered as Crl.P.No.13625 of 2010, for the self-same relief and the same was disposed of by this Court on 03.11.2011 observing that there are no grounds to quash the First Information Report, however the arrest of the petitioner/accused No.1 was stayed till completion of investigation. A copy of the said order dated 03.11.2011 passed in Crl.P.No.13625 of 2010 is placed on record. In view of the above, this criminal petition is also disposed of. However, the arrest of the petitioner is stayed till completion of the investigation.
