ORDER: (Per Hon’ble Sri Justice Ghulam Mohammed) This writ petition is filed seeking to issue a writ of Mandamus declaring the action of the first respondent in issuing the notice, dated 01.02.2011, under Section 13 (4) of Securitization and Reconstruction of Financial Assets and Enforcement of Security Interest Act, 2002, taking the property bearing H.No.15-165, situated at Piduguralla Village, Guntur District, of the petitioner into the custody of the bank as illegal and arbitrary. It is represented by learned counsel for the petitioners that the auction in respect of the said property was already conducted and as such, nothing survives for adjudication in this writ petition. Recording the said submission, this writ petition is dismissed as having become infructuous.
