Operative part

First Class, Peddapalli filed by the 2nd respondent under Section 12 of the Protection of Women from Domestic Violence Act, 2005. The case filed claiming maintenance of Rs.5,000/- per month and also return of dowry amount of Rs.4,25,000/-, gold ornaments worth Rs.1,40,000/- and household articles worth Rs.1,00,000/-. The 1st petitioner is husband of the 2nd respondent. The petitioners 2 and 3 are parents, the 4th petitioner is maternal aunt and the petitioners 5 and 6 are brothers-in- law of the 1st petitioner. Domestic Violence is alleged against all of them by the 2nd respondent. Having regard to allegations in the case filed by the 2nd respondent in the lower Court, I do not find any grounds to quash the case at its threshold. At any rate, the 1st petitioner is working in Indian Army and he is stated to be stationed at Delhi and the petitioners 5 and 6 are working as Teacher and Lecturer in Nalgonda District. In the circumstances, their appearance in the lower Court at Peddapalli of Karimnagar District on every date of adjournment would cause some difficulty to them. In the result, the Criminal Petition is dismissed. However, the lower Court is directed to dispense with personal attendance of the petitioners 1, 5 and 6 in D.V.C.No.6 of 2009, except on the date of delivery of judgment/order in that case. ____________________________ SAMUDRALA GOVINDARAJULU,J Dt. 2nd November, 2011.
