Learned counsel for the petitioner requested his Courl to dispense with the presence of the petitioner in C.C.l'1, ,.15 ol 201 l, and submitted that the petitioner will appear before tlrr leamed trial Couft whenever his physical presence is required.

Learned Special Public Prosecutor has not opposed the submission made by the leamed counsel for the petitic rer.

Taking into consideration the above submissi,l rs, this Courl is not inclined to quash the proceedings against the pe -itioner, since C.C.No.15 of 201 1 is coming up for examination unctr r Section 313 of the Cr.P.C. However, the presence of petitioner/ r ;cused before the learned First Additional Special Judge for SPE arr I ACB Cases, Hyderabad, in C.C.No.15 of 20ll is dispensed with, subject to the , condition that the petitioner/accused shall be represented by his counsel on every date of hearing, unless his presence is specifically required during the course of the trial. In the event of non- appearance on any date so fixed by the trial Court, the trial Court shall be entitled to proceed with the matter in accordance with law.
