ORDER Grievance of the petitioners is that non-bailable warrant was issued against them by the lower Court in a case relating to Section 138 of the Negotiable Instruments Act, 1881, while dismissing their petition under Section 317 Cr.P.C. It is contended that the second petitioner was suffering from Jaundice. Medical certificate is filed herewith. The petitioners should have approached the lower Court with a petition under Section 70 (2) of Cr.P.C for recalling the non-bailable warrant issued against them. Instead, they rushed to this Court with this petition. Hence, the criminal petition is dismissed giving liberty to the petitioners to approach the lower Court with a petition for recalling non-bailable warrant issued against them under Section 70(2) Cr.P.C, in which event, the lower Court will dispose of the same on the same day sympathetically. ___________________________ SAMUDRALA GOVINDARAJULU,J Dated 25.06.2012
