Petition under Article 226 of the constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court will be pleased to issue a direction; order or Writ more particularly one in the nature of Writ of Mandamus; a) Declaring the action of the respondents in proceeding with the Departmental promotion committee for the purpose of promoting Sub-Divisional Engineers to the post Divisional Engineers without recasting the seniority in accordance with orders passed by the Hon'ble Supereme Court of India on 28-09-2006 in I.A. No. 16 in Civil Appeal No. 4339 of 1995 as arbitrary, illegal and unjust; and b) consequently direct the Respondents to recast the seniority duly taking into account the principles down in I.A. No. 16 in Civil Appeal No. 4338 of 1995 dated 28-09-2006 and pass such other and further order or orders as this Hon'ble Court in the interests of Justice deem fit and appropriate inthecircumstances of the case. ORDER :
This writ petition has been filed by the petitioner under Article 226 of the Constitution of India seeking to consider his grievance and to pass order in his favour and against the respondent-authorities.
When the matter came up for hearing, it is represented that in view of the notification dated 31.01.2008 issued by the Ministry of Personnel, Public Grievances and Pensions, Government of India, the respondent department is also included within the jurisdiction of Central Administrative Tribunal.
In the light of the said notification, this Court is of the view that this writ petition needs to be transferred to Central Administrative Tribunal. Accordingly, this Writ Petition is withdrawn and transferred under Section 29(2) of Central Administrative Tribunal Act, 1985, to Central Administrative Tribunal bench at Hyderabad.
