THE HON’BLE MR. JUSTICE RANJAN GOGOI A preliminary objection has been taken by Sri DC Chakraborty, learned CGC as wel l as Sri AM Mazumdar, learned Senior Counsel appearing for the private Responden ts that the subject matter of the writ petition falls within the jurisdiction of the learned Central Administrative Tribunal by virtue of the provision containe d in Section 14 of the Central Administrative Tribunal Act, 1985. Learned counse ls, therefore, have submitted that the petitioners should be directed to approac h the learned Central Administrative Tribunal in the first instance. On due consideration of the provision contained in Section 14 of the Act and aft er hearing the learned counsel for the petitioners, the Court is of the view tha t the subject matter of the writ petition being within the jurisdiction of the l earned Central Administrative Tribunal, this writ petition should not be enterta ined any further. Writ Petition accordingly is closed with liberty to the petitioners to approach the learned Central Administrative Tribunal, if so advised. Interim order passed earlier is vacated.
