Petition under Article 226 of the Constitution of India, praying that in the circumstances stated in the petition and the affidavit filed herein, the High Court may be pleased to issue an appropriate writ, order or direction more particularly one in the nature of writ of mandamus, declaring the action of the 1st respondent in accepting tenders of the respondents 3 and 4 in respect of Departmental Store and Scooter Parking in JBS, Secunderabad is highly arbitrary, contrary to the terms and conditions of the tender schedule, illegal and unsustainable and consequently direct the 1st respondent to accept the tenders of the petitioners; The petition coming on for hearing, upon perusing the petition and the affidavit filed herein, the order of the High Court dated 18-04- 2012 made herein and upon hearing the arguments of

ORDER:
“Learned standing counsel opposes granting any further extension of the interim order passed yesterday by me. Today, he has produced the inward register where entries are found about the receipt of tenders. The important question raised in the writ petition relates to non-transferability of the tender forms. The allegation of the writ petitioners is that, tender forms have been transferred in the name of the successful bidders and ignoring the tender condition in that regard, their tenders have been accepted by the Corporation. The Corporation having incorporated a condition that the tenders are non-transferable, could not have violated the said terms while processing the tenders.
