This writ petition is filed by the Yemmiganur Weavers Cooperative Production and Sales Society Limited seeking a writ of certiorari to quash the
order of respondent No.1 in S.A.No.7 of 1998 dated 25.05.1999, confirming the order of respondent No.2 in S.A.No.2 of 1996 dated 09.06.1997. Respondent No.3 approached the authority under the provisions of the Andhra Pradesh Shops and Establishment Act, 1988 (for short, the Act), and an order was passed in S.A.No.2 of 1996 on 09.06.1997 directing the petitioner herein to reinstate respondent No.3 herein without back wages and with continuity of service. The said order was confirmed in appeal in S.A.Nos.1 and 7 of 1998. Respondent Nos.1 and 2 are merely proforma parties, and it is respondent No.3 who is the necessary and proper party to the writ petition as it is he who had invoked the jurisdiction of the competent authority, under the Act, against the petitioner. The writ petition has already been dismissed against respondent No.3 by order of this Court dated 06.04.2009. As such the writ petition necessitates dismissal, and is accordingly dismissed, against respondent Nos.1 and 2.
