The petitioners question the action of the respondents in conducting public auction of the leasehold rights of agricultural land, admeasuring Ac.2.57 cents in R.S.No.114/6 of Tadiparru Village, Undrajavaram Mandal, West Godavari District, on
21.05.2010. It is the case of the petitioners that they are cultivating the
lands belonging to the third respondent-temple; the first petitioner paid makta of Rs.14,000/- on 06.02.2010 towards Ac.2.00; the second petitioner paid makta of Rs.3,390/- on 29.03.2010 towards Ac.0.57; and the third respondent, without issuing a notice under Rule 5 of the Rules notified in G.O.Ms.No.379, had issued a public advertisement for conducting auction of the leasehold rights of the land in question on 21.05.2010. The petitioners sought stay of the auction proceedings by way of the present writ petition. When the Writ Petition was listed on 20.05.2010 this Court merely directed that the matter be adjourned after Summer Vacation, 2010. In the absence of any order from this Court, the respondents were not precluded from holding the auction on 21.05.2010. Sri V.T.M.Prasad, Learned Standing Counsel for the third respondent-temple, would submit that the auction was indeed held on 21.05.2010. Since the auction has already been held, I see no reason to now interdict the auction proceedings. Suffice to observe that the petitioners are entitled to avail any other remedy available to them in law questioning the action of the respondents in conducting the auction. The Writ Petition is, accordingly, dismissed. However, in the circumstances, without costs. Date:31.05.2010 RAMESH RANGANATHAN,J
