Petition under Article 226 of the Constitution of lndia praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue a writ order or direction especially one in the nature of Writ of Mandamus declaring that, a) the action of the Respondents in not making payment of terminal benefits to the Petitioner in pursuance of letter/ proceedings issued by the Principal Accountant General (A and E), Hyderabad in Lr.No.AG(AandE)lP14lllN449lSP573l2025-O813734 dated. 10.12.2025 is illegal, arbitrary and discriminatory, violating Article 14' 16 and 300-A of the Constitution of lndia. b) further declare that, the Respondents shall forthwith release all terminal benefits payable to the Petitioner including Death-cum-Retirement, Gratuity, commutation of Pension, General Provident Fund amount and encashment of Earned Leave and Earned Leave amount and -other benefits in pursuance of his retirement dated 31 .12.2024 and the proceedrngs in Lr.No.AG(A andE)tp14illN-44gtsp573tzo25- 0813734 dated. 1012 2025 of the Principal Accountant General (AandE), Hyderabad viz., an amount of Rs.16,00,0001 sanctioned towards retirement gratuity viz., Rs.9,06,498/- sanctioned vide Token No.2602956267 dated 21 .01 .2026 and Rs.6.93,5021 - sanctioned vrde Token No.2602956270 dated 21.01.2026 respectively, further an arnount of Rs.30,80,229l- sanctioned towards commutation Value of pension viz, Rs.17.45,138/ - sanctroned vide Token No.2602956280 dated 21 ,01 .2026 and Rs 13,35,0911 sancrioned vide Token No 26029562g7 dated 21 .01 2026 respectively, the Service Pension of the Petitioner was fixed as Rs.79,293/-, Encashment of Leave anrount of Rs.21 ,40,786t- sanctioned vide Token No.2524216418 dated 3.1.03.2025, DA Arrears amount of Rs.'1 ,84,864r sanctioned vide Token No.25237g5397 dated 31 .03 2025 and DA Arrears amount of Rs,35,436/- sanctioned vide Token No.2600945220 daled 12.07 .2025 c) the Respondents have no right or power to withhold the terminal benefits payable to the Petitioner after his retirement. l.A. #4. l,earned Assistant Government Pleader for Services-lll did not disputc the submissions madc by learned counsel for the petitioner with regard to thc disposal of W.P.No.23738 of 2025 dated 03.09.2025 and submits tl-iat the respondents will release the amounts on a priority basis of the token numbers and prayed this Court to pass appropriate orders.
