ORDER This is an application filed by the Official Liquidator representing M/s. Neeraj Petrochemicals Limited (in liquidation) under Section 462 of the Companies Act, 1956 read with Rules 306 and 298 of the Companies Court Rules, 1959, to condone the delay of 107 days in filing the half yearly accounts along with audit report for the period from 1-4-2009 to 30-09-2009 and take the half yearly accounts on record and permit him to pay the balance audit fee to the auditors. Along with the application, the Auditor’s Report dated 30-12- 2010 submitted by Murthy and Kanth, Chartered Accountants, has been placed on record. Heard the learned counsel appearing for the Official Liquidator and perused the affidavit filed in support of the application. The circumstances, under which the delay in filing the Auditor’s Report, have been stated in paragraph No.5 of the affidavit. In that view of the matter, the delay of 107 days in filing the half yearly accounts along with the audit report, is condoned and the half yearly accounts along with audit report for the period from 1-4-2009 to 30-09-2009 has been taken on record. The Official Liquidator is permitted to pay the balance audit fee to the auditors. Accordingly, the company application is allowed.
