As on today, only IPC offences are taken cognizance against the petitioner and the offence under the Prevention of Corruption Act, 1988 is pending for want of sanction for prosecution to be issued by the appropriate Governments. It cannot be said that there is no triable case against the petitioner. Having regard to the gravity and stage of the case before lower Court and pendency of further investigation, I do not find any valid reasons to grant bail to the petitioner at this stage. Completion of examination of the petitioner by Enforcement Directorate has any bearing in deciding this petition.
