Petition under Article 226 of the constitution of India praying that in the circumstances stated in the Affidavit filed herein the High Court will be pleased to issue a Writ or Mandamus or any other appropriate Writ order or direction declaring that Andhra Pradesh (Agricultural Produce & Livestock) Market Act, 1966, has no application to the prawn trade and accordingly declare that the petitioner is not liable to pay licence fee & market fee and interdict the respondents from taking any action against the petitioner under the said Act. ORDER:
There is no representation on behalf of the Respondent No.2- Industries Department as well as Respondent No. 3 to 13-Agricultural Marketing Committee. It is submitted by the learned Government Pleader appearing for Respondent No.1-Food and Agriculture Department and admitted to by the learned counsel for the petitioner that the subject-matter of this writ petition is squarely covered by the decision of the Division Bench of this Court in W.A. No. 829 of 1989 and batch, dated 14-7-1996. In the circumstances, following the judgment in W.A. No.829 of 1999 and batch, dated 14-7-1996, and for the reasons mentioned therein, this writ petition is liable to be dismissed, and the same is accordingly dismissed.
