ORAL ORDER:
Operative part
This writ petition is filed questioning the validity of the order dated 7.8.2000 passed by the Revenue Divisional Officer, Paloncha in Khammam District. The petitioner was appointed as Fair Price Shop dealer under the provisions of the A.P. Scheduled Commodities (Regulation of Distribution by Card System) Order, 1973 made under the Essential Commodities Act, 1955. Alleging certain irregularities, authorization granted to the petitioner was suspended by the impugned order pending further orders. This court at the stage of admission, by order dated 21.8.2000 suspended the order impugned herein and the said order was also made absolute by further orders dated 26.8.2003. There is no representation on behalf of the respondents. It is the case of the petitioner that the impugned order is passed without any notice and enquiry. I have perused the impugned order and it does not indicate issuance of any prior notice to the petitioner. It shows that the order of suspension is passed as an interim measure pending further orders. In that view of the matter, I dispose of the writ petition directing the respondents to complete the enquiry, if not already completed, as expeditiously as possible, and, preferably within a period of three months from the date of the receipt of a copy of this order and till completion of enquiry and appropriate final orders are passed, the impugned order shall remain suspended. Subject to above direction, the writ petition is disposed of. No order as to costs. _____________________ 29-8-2007 R.SUBHASH REDDY, J. VR
