Respondents This writ petition is filed aggrieved by the action of respondent No.3 - the District Collector,'Ranga Reddy District' Kongara Kalan, Ranga Reddy District' in Lr.No.E,1/208 12025 dated ll'06'2025 to respondent No'6 - the Commissioner & Inspector General, Stamps & Registration issuing Department, Telangana, Hyderabad, recommending the application dated 01.0.2025 of respondent No.9 without giving notice to the Prge 2 of 9 BVRJ WP No.9701, of 2026 pattadil and possessor of the land admeasuring Acs.6-00 guntas in Survey No.37lLU, Gopannapally Village, Serilingampally Mandal, Ranga Reddy District and without considering the representations dated 01.06.2016 and 29.02.2024 of the petitioner as illegal, arbitrary and in violation ofthe principles ofnatural justice.
2.1. It is claimed that the petitioner is owner of the land admeasuring Acs.6-00 in Survey No.37lLU of Gopannapally Village, Serilingampally Mandal, by virtue of the registered document No.5110/2009 dated 25.09.2009 executed by one Mr. Sabhavath Raju, son of Mr. Sabhawath Pomla, and others as consenting parties. That the subject land originally belong to one Mr. Tholli Siddhoba who was recorded as pattadar in the Khasra Pahani of 1954-55, Sessala Pahani of 1955-58 and subsequent pahanies from 1960-63. After the death of Mr. Tholli Siddhobha, his son Mr. Tholli Mahadev succeeded to his property and was recorded as pattadar and possessor in the pahanies from 1966 to 2004 in respect of the subject land. Since 2005 till date, Mr. Tholli Mahadev is recorded as pattadar and Mr. Sabhavath Raju as possessor in the pahanies in respect of the subject land. - Page 3 ot9 BI'RJ lVP No.9709 of m26
2.2. It is stated that Mr' Sabhavath Raju' vendor of the petitioner, entered into an agreement of sale dated 27 '07 '1982 wit}. Mr.TholliMahadev, sonoftheoriginalpattadarandpossessor Mr. Tholli Siddhobha, along with Mr' Tholli Siddu Bai and Mr. Tholli Suman in respect of the subject land' Part sale consideration was paid by the vendor of the petitioner under Exs.P-5 and P-6 receipts dated 21'05'1985 and 18'05'1998' respectively and the same were impounded and validated under File No.1221 lCorfil2O19 dated 07'02'2019' I;rt' 2017' suit for injunction in O.S. No.60 of 2017 was filed against a third party viz., Mr. Prasad. It is submitted that the pattadars Mr' Tholli Mahadev, Mr. Tholli Sidhu Bai and Mr' Tholli Suman executed unregistered sale deed dated 04'05'1991 in favour of Mr. Sabhavath Raju pursuant to the agreement of sale dated 27.07.1982 and the same was impounded vide File No.14204lCourt/2018dated04.|2.2018(Ex.P-7)intheabovesuit inO.S.No.60of2OlTbytheDistrictRegistrar'RangaReddy District. 2.3. It is submitted that some of the pattadars in Survey Nos.36 and,37 of Gopannapally Village along with the vendor of the petitioner filed W.P. Nos.217l9 of 1997 and l73l of 2005 aggrieved by the suo motu exercise of revisional jurisdiction under Section 166-8 of the Andhra Pradesh (Telangana Area) Land Revenue Act l3l7 Fasli to modifl, entries in pahanies and challenging G.O. Ms. No.850, Revenue (ASN-III) Department, dated, 24.09.1991, reserving an extent of Acs.477-00 guntas in Survey Nos.36 arrd 37 of Gopannapally Village, Ranga Reddy District, for providing house sites to the Govemment employees. By the cortmon order dated 15.09.2009, this Court allowed the writ petitions setting aside G.O. Ms. No.850 dated 24.09.1991. Questioning the same, W.A. Nos.273 and 323 of 2010 were preferred and the same were dismissed by the order dated
08.06.2010. Challenging the same, Civil Appeal Nos.325, 326 and 327 of 2015 were preferred before the Apex Court and the same were dismissed by the order dated 13.01.2015.
2.4. It is submitted that pursuant to the orders in W.A. No.273 of 2010 and batch dated 08.06.2010, the petitioner 7 Page 5 of9 BVRJ WP No.9?09 of 2026 filed W.P. No.22867 of 2010 (Ex'P-8) seeking demarcation of subject land and the writ petition was disposed of with a direction for conducting survey and demarcation of the subject land' Pursuant to the same, the office of the Assistant Director of Survey and Land Records, Ranga Reddy District, conducted survey under Ex.P-9 File No.Rc.No.A4t2274l2OO9 dated 01'04'2010 and the Deputy Collector and the Tahsitdar, Serilingampatly Mandal under Ex,P-10 File No.B/224 l2Oll dated 17 '02'2012 by issuing notice to the petitioner and other interested persons and demarcated the subject land and assigned Podi No'37/3 to the vendor of the petitioner Mr. Tholli Mahadev.
2.5. It is submitted that Mr. Thotli Mahadev, who is pattadar and vendor of the petitioner, has filed O'S' No'331 of 2018 before the Court of II Additional Senior Civil Judge, Ranga Reddy District, at L.B. Nagar, when one third pxty viz', Manne Raghava Rao has filed a frivoious suit seeking specific performance of an oral agreement in respect of the subj ect land against the pattadar' In the said suit, Mr. Tholli Mahadev, in his written statement under Ex.P-l1, admitted about sale of the subject land to Mr' Sabhavath -^- ,-,a .'. d ,. r,l '.$ ,# ,:!+ .. :rli ;#.- ,:'M Pege 6 ofg BVRJ WP No.909 of z)26 Raju and subsequent registered agreement of sale cum General Power of Attomey with possession under Ex.P-12 Document No.5110 of 2009 d^ted 25.09.2009 executed in favour of the petitioner.
2.6. While so, when respondent No.9 tried to interfere with the possession of the petitioner over the subject land on the strength of Document No.4125 of 1984, the petitioner filed O.S. No.l8 of 2019 (Ex.P-13) before the VIII Additional Senior Civil Judge, Ranga Reddy District at L.B. Nagar, for declaration of Document No.4l25 of 1984 dated 06.07.1984 in rhe name of Mr. Amanacherla Narsimha Rao who is the father of Mr. Amanacherla Mallikarjuna Rao, as null and void, ab initio and not binding the petitioner and also sought cancellation of the said sale deed. The suit was transferred to the Court of the Senior Civil Judge cum Assistant Sessions Judge, Kukatpally, and is renumbered as O.S. No.823 of 2O2l (Ex.P-14). The said suit was dismissed for non-prosecution and steps are being taken for restoration of the suit and the application IS pending for adjudication. 1 I { , Page 7 of9 BVRJ WP No.9709 of 2026
2.7. ltis submitted that the petitioner filed a suit against one Mr. Manne Raghava Rao vide O'S' No'998 of 2018 before the Court of I Additional Senior Civit Judge, Ranga Reddy District at L.B. Nagar,, and obtained interim order of status quo vide I.A. No.345 of 2018 restraining him from interfering with his possession over the subject tand' Subsequently, the suit was transferred to the Court of the Senior Civil Judge curn Assistant Sessions Judge, Ranga Reddy District at Kukatpalty and renumbered as O.S. No.1585 of 2021 which is pending for final adj udication.
2.8. It is submitted that respondent No'3 issued the impugned letter in favour of respondent No.9 without considering the official records o[pahanies and without service of notice to the possessor olthe subject land and legal heirs of pattadars who are in possession of the subject land; moreover, when the comprehensive suit is pending between the parties in O.S. No'823 of 2021 before the Court of the Senior Civil Judge cum Assistant Sessions Judge, Kukatpally; further tl.re representations dated 12J0'2025 md Prg€ t ot9 BI'RJ WP No.9709 of m26 d4
13.11.2025 made to respondent Nos.3 and 7, respectively, are also not considered.
#3. Mr. Vedula Venkata Ramana, leamed Senior Counsel, appearing for Mr. P. Sri Harsha Reddy, leamed counsel for respondent No.9, submitted that the dispute between the petitioner and respondent No.9 needs to be adjudicated in the civil suit in O.S. No.823 of 2021 which is admittedly pending on the file of the Senior Civil Judge, Ranga Reddy District at Kukatpally. The impugned letter is issued directing de-notification of the subject Iand from the prohibitory list which in a way enure to the beneht of the petitioner also as the subject land was wrongly notified in the prohibitory Iist.
#4. In response, Mr. Sunil B. Ganu, leamed Senior Counsel, appearing for Mrs. Manjiri S. Ganu, leamed counsel for the petitioners, submitted that the impugned letter will be taken advantage of by the petitioner to make a claim of title over the subject land which will prejudice rights of the petitioner in the pending civil suits and before the revenue authorities Pag.9 ot9 BVR.I wP No.9709 of 2026

In the light of the above submissions' it is made clear that the impugned Lr.No.E1/208 12025 dated ll'06'2025 issued by respondent No.3 shall not have any impact in any pending suits or proceedings betbre any authority as it was issued by respondent No.3 recommending for de-notification of the subject land from the prohibitory list. The trial Courts / authorities shall not be influenced by the impugned letter in Lr' No'E1/20812025 dated
11.06.2025 issued by respondent No'3 while adjudicating the suits / related issues. Accordingly, the writ petition is disposed of' at the admission stage itself.
