#2. Heard Mr.B.Balaji, learned counsel representing Mr. P.K.Satyanarayana, learned counsel for the petitioners, and Mr. Jithender Rao Veeramalla, lcarned Additional Public Prosecutor, appearing for respondent No. 1 .
#3. With the consent of both the parties, this criminal petition is disposed at the stage of admission.

Learned counsei for the petitioners submitted that the petitioners have not committed any oflence and have been falsely implicated in the present crime solely based upon the confession statement given by the co-accused. Even according to the allegations made in the complaint, the ingredients of the offences under Sections 318(4) of the BNS and Section 5 of Telangana Protection of Depositors of Financiat Establishment Act, 1999 and Sections 3 and 4 of the PC & MCSBA are not attracted against the petitioners. Hence, the continuation of the proceedings against the petitioners is a clear abuse of process of law. He further submitted that One Mr. Kethireddy Devender Reddy, who is also one of the accused in the very same offence, had approached this Court by filing Crl.P.No.313O of 2026, and this Court on 09.03.2026, disposed of the +aid criminal petition directing the Investigating 4 Officer to follow the procedure as contemplated un I :r Section 35(3) ol the BNSS and the guidelines issued by thc Apex Court in Arnesh Kumar Vs. State of Bihart. Therefore, tl-< petitioners are also entitled to the very same relief.
#5. Per Contra, learned Additional public prosr ( utor submitted that the Investigating Officer has already issr_r,: I notice under Section 35(3) of the BNSS to the petitioners on 25. I 2.2026. Instead of submitting a reply to the said notice, the petiticr er has filed the present criminal petition, and therefore, tht same is not maintlinable under law.
#6. Learned counsel for t-he petitioners by way o- .eply submitted that the petitioners are directed to submit reply t ) the said notice issued under Section 35(3) of the BNSS. 7 . Having considered the rival submissions made by the respective parties and upon perusal of the mater al available on record, it reveals that this Court on Og .03.2Cl26 lrsposed of the CrI.P.No.3l30 of 2026 and directed the InvestilJ, ting Officer to follow the procedure contemplated under Sectit I 3S(3) of the BNSS, and the guidelines issued by the Apex O ,urt in Arnesh Kumar Vs. State of Bihar2. Even according o the learned I(2014) 8 SCC 273 2(2ot4l a scc 273 5 Additional Public Prosecutor, the Investigating officer has already issued notice under section 35(3) of the BNSS to the petitioners. In view of the same, the petitioners are entitled [o submit their reply to the notice by raising all the pleas which are available to them by enclosing all relevant documents, which are in their possession.
