The petitioner claims to be protected tenant in respect of the land comprised in survey Nos.387 (New 875), 388 (New 876), 389 (New 879), 390 (New 876), 473 (New 911) and 475 (New 907) in The Nizamabad Village and Mandal petitioner’s claim for grant of ownership certificate under Section 38E in Nizamabad District. of A.P. (Telangana Area) Tenancy & Agricultural Lands Act, 1950 (the Act, for brevity) was rejected. Feeling aggrieved by the same, the petitioner preferred an appeal before the Joint Collector, Nizamabad allegedly in April 2003. The grievance of the petitioner now is that the Joint Collector did not dispose of the appeal expeditiously. At the stage of admission itself, learned Assistant Government Pleader for Revenue (General) has produced the file bearing No.F1/7221/2003, from the office of the District Collector. A perusal of the proceedings/note file would show that the matter was adjourned on number of occasions at the instance of the petitioner and finally the Joint Collector adjourned the matter on 02.7.2006 and posted the matter giving some more time to the petitioner to produce proof of his possession to consider the appeal. Now that the Joint Collector adjourned the matter giving time to the petitioner to produce necessary evidence. In view of the same, this Court is not inclined to pass any

order in this writ petition. The writ petition, with the above observations, is dismissed. No costs. July 25, 2006. YS _____________
