ORAL ORDER:

(per the Hon’ble Acting Chief Justice) The appellant challenged in the writ petition the order dated 8-11-2004 which is passed by the respondent under section 7-A of the Employees Provident Fund and Miscellaneous Provisions Act, 1952 (for short “the Act”) whereby a demand of Rs.1,96,601/- has been raised. Learned single Judge was of the view that there is an efficacious remedy available to the petitioner by way of appeal under Section 7(I) of the Act. He gave the petitioner liberty to file an appeal and also granted stay of further proceedings pending the appeal to be filed subject to the condition of the petitioner depositing 50% of the amount demanded. The Court has exercised its jurisdiction in favour of the writ petitioner-appellant and we do not see that the petitioner could have any grievance against the order passed by the learned single Judge.
