HONOURABLE SRI JUSTICE P. SWAROOP REDDY WRIT PETITION No.11581 OF 2006 ORDER: (Per Hon’ble Sri Justice D.S.R. Varma) This writ petition is taken up based on a telegram received from one Tummuru Anjali, who is sister of alleged detenu No.1 and daughter of alleged detenue No.2, stating that detenu Nos. 1 and 2 were arrested illegally by the Police of Reddygudem Police Station, Krishna District. A counter has been filed by the Station House Officer, Reddygudem Police Station, Krishna District, stating that detenu No.1 was arrested in connection with Crime No.17 of 2006 for the offences punishable under Sections 447, 323 and 379 read with Section 511 of Indian Penal Code, a case was registered and investigation is going on. It is stated in the counter affidavit in respect of alleged detenue No.2, who was alleged to have been arrested by the police, that she is not required by the police in any offence, therefore, there is no necessity for the police to take her into custody. Added to that, the police filed a certificate said to have been issued by the Secretary of the Reddygudem Panchayat, Krishna District, stating that he found detenue No.2 freely moving at her house. Having regard to the statement made by the police, particularly, in view of the statement that alleged detenue No.2 is not required in any offence and there is no need for them to arrest her, we feel that no orders are required to be passed in this writ petition.
