Haiyale Kath, learned counsel for the petitioner. Present PIL has been filed with the following prayers: “I. Direct the Respondents to recall the poor quality PPEs procured which are already dispatched to the COVID-19 designated Hospitals. II. Direct and call for Central Bureau of Investigation as per the principle of natural justice and Nemo judex in causa sua to register a case and conduct investigation into the procurement of goods for the purpose of COVID-19 in Nagaland and submit its report before this Hon’ble Court and initiate proper legal proceedings against the officials involved in misappropriation of funds for procuring poor qualities of public goods during the pandemic COVID-19 under the supervision of this Hon’ble Court. III. Direct the Respondents No. 1 and 2 to collaboration with other concern public authorities and regulate the price of medical equipments, PPEs, Masks, drugs, surgical equipments to facilitate and ensure that the State get a fair chance of survival during this pandemic by putting in place all the essential medical equipments required for treating the disease.

Direct the Respondents Nos. 1 and 2 to set up a monitoring committee comprising of experts and social workers of exceptional repute to facilitate procurement of public goods and prevent misappropriation of public funds. V. Direct the Respondents to upload all the information on procurement of public goods as mandated by RTI Act within a period of 2 weeks. VI. Direct the Respondents to strictly maintain the Standard Operating Procedure (SOP) for public procurements to promote transparency and accountability.” After considering the prayer of the petitioner as well as the affidavit filed by the State respondents, as well as the respondent Nos. 3, 4, 5 and 6 we are of the opinion that the present PIL has become infructuous.
