Heard Mr.S.K.Sinha, learned counsel appearing for the petitioner and Mr. H.Sarma , learned CGC for all the respondents. In the present writ petition, the petitioner is challenging the discharge order dated 8th September, 2003. The petitioner, who was working as Ri fleman/Cook, was discharged from service after 4 Red Ink Entries were made in his service book. The respondents have filed their affidavit-in-opposition in whic h it has been stated in para No.7 that the authorities have reviewed and changed the policy regarding discharge of any Assam Rifles personnel from service on th e ground of 4 Red Ink Entries in view of the decisions of this Court as well as the Hon’ble Supreme Court. It has been also stated that the authorities have dec ided to convert the dismissal of Assam Rifles personnel under 4 Red Ink Entries into discharge enabling the individual concerned to earn pensionary benefits in accordance with Rules. It has been also stated in the said affidavit-in-opposition that the pensionary benefits have already been sanctioned in favour of the petitione r. like to press the present writ petition. In view of the above, the petitioner submits that he would not Accordingly, the present writ petition is disposed of as not pre ssed.
