HON’BLE MR. JUSTICE C.R. SARMA Heard Mr. S.M. Mollah, learned counsel appearing for the petitioner. Also heard Mr. N.J. Dutta, learned addl. P.P., Assam, appearing for the State respondent. By this application filed under Section 438 Cr.P.C. the petitioner, namely, Sri Hemanta Saikia has prayed for pre-arrest bail in connection with Nalbari P.S. C ase No. 411/2013 registered under Sections 366/34 IPC. It is submitted that the petitioner was a juvenile at time of occurrence. In view of above, it is ordered that in the event of arrest of the petitioner in connection with the above mentioned P.S. Case, if he is found to be a juvenile, at the time of occurrence, the arresting authority shall produce him before the Juvenile Justice Board constituted under Juvenile Justice (Care and Protection) of Children Act, 2000, for passing necessary order. With the above, this bail application is disposed of.
