Bhattacharyya, learned counsel appearing for the appellant. This is an appeal under Section 173 of the Motor Vehicle Act, 1988 against the Judgment and Order dated 13.11.2017 passed in MAC Case No.13/2011. Mr. A. Bhattacharyya, learned counsel appearing for the appellant submits that he has been instructed by the appellant not to press the instant appeal and makes an endorsement to the same effect. In view of the aforesaid endorsement, the instant appeal stands dismissed on withdrawal. The statutory deposit made at the time of filing along with any other deposit, if made is allowed to be refunded and/or adjusted as the case may be, by the Registry in accordance with law to the appellant.
