Learned counsel for the petitioner submitted that the petitioner, namely , Sri Kanu Debnath has been falsely implicated in Lanka P.S. Case No. 307/2013 u nder Section 420 IPC. It has also been stated that petitioner’s being at large is necessary since his wife is now on family way. In view of the above, learned counsel for the petitioner has requested this Court to grant the petitioner pre -arrest bail. I have heard the learned Additional Public Prosecutor appearing for the state wh o has objected the prayer for pre-arrest bail contending that the involvement of accused/petitioner in the crime in question is well apparent in view of materia ls in the case diary. On the perusal of the materials in the case diary and having regard to t he submissions advanced by the learned counsel for the parties, I am of the opin ion that at this stage of the investigation, the prayer for pre-arrest bail cann ot be granted and as such the same is rejected. This proceeding is accordingly disposed of. Return the case diary.
