This is an application under Section 438 of Cr.P.C., seeking pre-arrest bail of the accused-petitioner, namely, Md. Jabidul Ali Akand @ Jabedul Akand, in connec tion with Kokrajhar P.S. Case No. 26/2010, under Sections 365/376/292(1)/109 of IPC read with Section 7(1)(a)(1) of the Cinematography Act, 1952. Heard Mr. H. Ali, learned counsel, appearing for the accused-petitioner, and Mr. BB Gogoi, learned Addl. P.P. for the State of Assam. Learned Additional Public Prosecutor, Assam, has informed the Court that the cha rge sheet in connection with the aforementioned case has already submitted. In view of the above and also considering the facts and circumstances of the cas e, the accused-petitioner is directed to appear before the learned Court below f or regular bail. In the event of filing such application by the accused-petitioner, in connection with the case aforementioned, the learned Court below shall consider and dispos e of the same in accordance with law. This bail application stands disposed of in terms of the above direction.
