24.07 .2025 ORDER Heard Mr. M.U. Ahmed, learned counsel for the parties. Also heard Mr. T.C. Chutia, learned Addl. Senior Government Advocate for the State respondents. The petitioner is aggrieved by non consideration of his promotion in the post of Assistant Engineer under the Town & Country Planning Department. The petitioner is presently serving as Junior Engineer in the Town & Country Planning, Guwahati. The learned counsel for the petitioner submits that the petitioner fulfils the eligibility criteria and notwithstanding a vacancy being available, his candidature was not considered. Being aggrieved he has filed this writ petition. During the pendency of this writ petition the private respondent No.7 in WP(C) No. 5971/2023 was recommended for promotion to the post of Assistant Engineer. The petitioner being aggrieved has filed the subsequent writ petition being WP(C) No. 5971/2023. Considering that the petitioner’s grievance in WP(C) No. 3437/2023 is to consider his candidature for promotion and in the meantime the private respondent No.7 in WP(C) No. 5971/2023 had been recommended and promoted and the promotion of private respondent No.7 is challenged in WP(C) No.5971/2023, therefore, no further cause is alive in WP(C) No. 3437/2023. Accordingly, the same is disposed of as infructuous. Interim order, if any, stands vacated. Pending Interlocutory Application, if any, is also dismissed. Page No.# 3/3 JUDGE Comparing Assistant
