BEFORE HONOURABLE MR. JUSTICE SOUMITRA SAIKIA Date : 06/10/2023 ORDER Heard Mr. N. M. Hazarika, learned counsel for the petitioner. Also heard Mr. J. K. Goswami, learned Additional Senior Government Advocate.

This writ petition is filed by the petitioner with the specific prayer that direction be issued to the State Level Committee to consider the claims of the petitioner and the recommendation of the District Level Committee, whereby the name of the petitioner was recommended for a Grade IV post under the office of Superintendent of Police, Nagaon.

#3. The DLC by its meeting held on 20.07.2017 recommended the case of the petitioner along with other similarly situated persons. However, the matter was not considered by the State Level Committee and accordingly a representation has been submitted by the petitioner before the Commissioner and Secretary to the Govt. of Assam, General Administration Department, Dispur, Guwahati-6 requesting for implementation or consideration of the recommendations of the SLC. However, no response was forthcoming from the said respondents and accordingly the writ petition has been filed.

#4. Mr. J. K. Goswami, learned Additional Senior Government Advocate who appears for the respondents submits that he has no instructions in the matter and therefore he prays for time.

Considering the prayers made in the writ petition, that the writ petitioner is aggrieved by the non consideration of her case by the State Level Committee in terms of the recommendations of the DLC, this court does not consider it Page No.# 3/3 necessary to keep the writ petition pending for want of instructions from the respondents.

Accordingly, writ petition stands closed with the direction to the State Level Committee to consider the case of the petitioner in terms of the recommendations made by the DLC in its meeting held on 20.07.2017, whereby the petitioner was recommended for a Grade IV post in the office of Superintendent of Police, Nagaon. The SLC will, upon due consideration, will pass necessary orders and serve a copy of the said order to the writ petitioner. If in the meantime the matter has already been placed before the SLC and the SLC has already considered case of the petitioner, then a copy thereof be served on the writ petitioner.

#7. With the above observations the writ petition stands closed. The directions contained be complied with within a period of 30 (thirty) days from the date of receipt of certified copy of this order. JUDGE Comparing Assistant
