The Foreigners Tribunal-II, Lakhimpur in Case No.621/2007, gave an adverse decla ration on 4.9.2009 against the petitioner and the same is under challenge in WP( C) No.254/2010. Mr. G P Bhowmik, the learned counsel submits that recently the applicant could o btain the certified copy of the 1966 Voters List of the Tufanganj (SC) Legislati ve Assembly Constituency, where names of his parents, Subal Sarkar and Suradhani Sarkar are shown as voters. Similarly the petitioner has obtained certified cop y of the 1989 Voters List of No.112 Dhakuakhana Legislative Assembly Constituenc y, where the petitioner’s name was included as a voter. The learned counsel submits that these are vital documents and the applicant be permitted to rely upon the Annexure-E and F Voter Lists, at the time of hearing of the WP(C) No.254/2010. Accordingly after hearing Mr. A Hussain, the learned Central Govt. counsel and M s. K Devi, the learned Govt. Advocate, Misc. Case is allowed. The 1966 Voters List and the 1989 Voters List shall be considered as the Annexur e-E and F in WP(C) No.254/2010, at the time of hearing of the main case.
